Senior Legal Counsel, Claims & Recovery Support
  • $153,029.00 per annum + superannuation

About the role

This role is responsible for the provision of high-quality, client-focused legal advice working closely with WorkSafe’s Claims and Recovery Support Division as well as supporting the Corporate & Commercial legal team to provide corporate, commercial and administrative legal advice to other divisions of WorkSafe.

The Claims and Recovery Support division has been created within WorkSafe to focus on supporting the recovery and the social and work participation of injured workers. This division will be transforming how WorkSafe provides support and service to injured workers to improve the outcomes they achieve.

Key accountabilities

  • Provide high quality, client focused, strategic and practical legal advice to WorkSafe’s Claims and Recovery Support Division. Providing legal advice in relation to claims management decisions including decisions regarding weekly payments and treatment and support decisions (medical and like).
  • Independently prepare or settle briefing material, submissions, correspondence, reports, legal documents, instruments and workplace polices and procedures.
  • Effectively advise the Claims and Recovery Support Division and negotiate, influence and assist in the resolution of disputed claims decisions.
  • Provide high quality, client focused, strategic and practical legal advice and assistance to other divisions of WorkSafe including advising on various corporate and commercial legal issues including contract law, corporate governance, administrative law and administrative review litigation;
  • Assist the Manager, Corporate and Commercial to develop legal skills of team members, including legal officers and legal counsel in the provision of advice to the Claims and Recovery Support Division, as well as other legal services provided to WorkSafe by the Corporate & Commercial legal team;
  • Assist the Director, Corporate Legal and General Counsel to manage and provide legal advice to key stakeholders as required;
  • Prepare (or assist with the preparation of) briefing papers for the Board, Chief Executive Officer, Executive Directors and Legal Sign Off Briefs on matters requiring their attention;

About you

You are a legal professional, with significant experience in providing high quality legal advice regarding WorkCover claims and/or other insurance claims advice. Your communication, negotiation and organisational skills are highly developed, and your strong interpersonal skills allow you to establish and maintain effective and collaborative relationships with a wide range of stakeholders. You have the ability to work independently, as well as a part of a high performing team.

Additionally, you will possess the following skills and experience:

  • Demonstrated experience providing high quality legal advice regarding WorkCover claims and/or other insurance claims advice at a senior level including advising on disputed decisions;
  • Excellent legal drafting skills;
  • Excellent negotiation and influencing skills;
  • High level strategic, analytical and critical legal decision making capabilities;
  • High level judgement in identifying and managing the resolution of issues of strategic impact and importance;
  • Proven ability to consult on complex and sensitive issues within critical timeframes and offer constructive solutions;
  • An understanding of the constraints of a statutory, regulatory environment and demonstrated ability to interpret and apply legislative provisions and judicial precedents where necessary;
  • Professional legal qualifications and admission to practice as a Barrister and Solicitor of the Supreme Court of Victoria
